George Zimmerman, the Constitution, and the shifting politics of self-defense

Within 24 hours of Seminole County, Fla., Judge Kenneth Lester issuing a stern order allowing George Zimmerman, the defendant in the Trayvon Martin murder case, to post a $1 million bond, the volunteer neighborhood watchman received over $25,000 in donations, bringing his defense war chest to nearly a quarter of a million dollars.

Mark O?Mara, Mr. Zimmerman?s attorney, wrote that donors have been lining up for several reasons ? that he?s been unfairly treated by the media, that he?s been falsely labeled a racist, and that donors, if they were in a similar position, would likely have done the same thing.

But in making an appeal for more funds, Mr. O?Mara also suggested on Friday that many Americans have given because they feel ?this case is an affront to their constitutional rights,? namely the 2nd Amendment right to bear arms.

To be sure, many commentators say the case has mainly to do with Zimmerman violating Martin?s equal protection rights by profiling him and then illegally depriving the boy of his basic constitutional right of life.

But judging by the speed and size of donations to the defense fund, it?s clear the case continues to provoke a separate debate about America?s shifting stance on gun rights and the constitutional case for self-defense.

?People ? are definitely thinking and talking about it,? Terrence Mayfield, 61, a Florida gun permit holder, told the New York Times a few weeks before the latest bond hearing. ?This whole thing rests on who threw the first punch. Either the gun saved Zimmerman?s life or we had a cowboy, someone who thought because he had a gun things could escalate.?

Zimmerman, who is in late 20s, shot Martin, an unarmed 17-year-old, after a scuffle on the night of February 26 in Sanford, Fla. Thousands of Americans rallied to the side of Trayvon?s parents, who demanded justice after local police decided they had no probable cause to disbelieve Zimmerman?s self-defense claim.

To Trayvon supporters, the fact that a half-white, half-Hispanic man went free after profiling Trayvon, an innocent black boy, as a criminal, chasing after him, and then shooting the unarmed boy reeked of racial inequality and even institutional racism. Others say Martin is the only one who had a legitimate self-defense claim as he lashed out against a combative stranger following him on a dark street.

But after the state, 44 days after the shooting, decided to charge Zimmerman with second-degree murder, evidence began to emerge showing glaring injuries sustained by Zimmerman to his head and face. While even Judge Lester this week called Zimmerman manipulative, evidence shows he did pass a non-admissible ?stress test? that suggested he was telling the truth when he said he feared for his life.

Zimmerman, who was heavier but shorter than Trayvon, has also stated he thought Trayvon was an adult, and that he wasn?t sure if he was armed or not. He said he reached for his 9 mm handgun after he believed Trayvon was going for it.

In late May, a Rasmussen poll found that 40 percent of Americans believed Zimmerman acted in self-defense while 24 percent believe it was murder.

While self-defense isn?t expressly written into the Constitution, legal scholars have long argued that the constitutional precept of ?liberty? implicitly means ?the right of self-defense against unlawful violence,? according to Thomas Cooley, a 19th century constitutional scholar.

But 40 US states, meanwhile, include in their constitutions both the right to bear arms and to use them in self-defense ? concepts that states like Florida and 23 others have built on in recent years with so-called ?castle doctrine? and ?stand your ground? laws that expressly state that lawful citizens have ?no duty to retreat? in the face of an attack, even in public.

Zimmerman?s main defense will likely be to seek immunity under the state?s stand your ground law.

Critics point to a recent study suggesting that such laws have significantly increased the rate of gun-related killings in states that have adopted them, as the number of what the FBI calls ?justified killings? has risen in concord. That study, by Texas A&M researchers, moreover suggests that the laws have not had a significant deterrent effect on criminals.

Yet as concerns about Constitutional gun rights swirl around Zimmerman?s defense, the case itself may have sparked more than debate, and may have inspired more Americans to actually use guns to protect themselves and their property, suggests University of Georgia emeritus law professor Ron Carlson.

Speaking about a string of cases in Athens, Ga., where lawful citizens used guns to thwart burglaries and attacks, Mr. Carlson suggested to the Athens Banner-Herald newspaper that ?awareness of [Georgia?s Stand Your Ground] law spiked after the Trayvon Martin case.?

?The existence of this sort of statute places an atmosphere or climate over various forms of human combat,? he said. ?It helps to create a mindset that is conducive to resistance when one is placed in a conflict situation.?

Such readings of America?s fundamental laws, especially as spurred on by the Trayvon Martin case, trouble some commentators, including Walter Rodgers, a former Monitor columnist, who wrote recently that ?Mexico, Colombia, Syria, Lebanon, Iraq, Afghanistan, Pakistan, Gaza and the West are awash in guns. Their societies are not ones that Americans should emulate.?

(AP) ? With the number of foreigners dwarfing that of locals in her hometown of Abu Dhabi, Asma al-Muhairi has become increasingly anxious at the prospect of her younger nieces abandoning their full-length black robes in favor of Western attire that seems to be everywhere she goes.

But it wasn't until the 23-year-old marketing worker came face to face with two scantily-clad female foreigners at one of the many luxury shopping malls in the United Arab Emirates that she decided to take action.

"While going to a mall, I saw two ladies wearing ... I can't say even shorts. It was underwear," said al-Muhairi, whose black abaya ? a long garment worn by conservative Gulf women ? is offset by a gold Versace watch and egg-shell blue handbag.

"Really, they were not shorts," she said. "I was standing and thinking: 'Why is this continuing? Why is it in the mall? I see families. I see kids around.'"

Failing to persuade the mall to intervene, al-Muhairi and another Emirati woman, Hanan al-Rayes, took to Twitter to air their concerns in May.

They were inundated with responses that prompted them to launch a Twitter campaign dubbed (at)UAEDressCode that aims to explore ways to combat the growing number of shoppers in low-cut dresses and hot pants.

As the campaign picked up steam, it also has served to symbolize the growing concerns among Emiratis, a tiny minority in their own country.

Emirati citizens account for a little more than 10 percent of the 8 million people living in the Gulf nation. Most of the population is made up of Asian, African and Middle Eastern guest workers, as well as Western expatriates living here temporarily.

The overall population more than doubled over the past decade as the country embarked on a building boom that transformed Dubai, up the coast from Abu Dhabi, into the Arabian Gulf's financial hub and a popular tourist draw.

"I think in an increasingly tumultuous region and in an era of powerful and often intrusive globalizing forces, citizens of the UAE are increasingly concerned that their traditions and core values are being eroded," said Christopher Davidson, an expert on Gulf affairs at Britain's Durham University.

"In some senses, it is a grassroots reaction to authorities and leaders that have for many years done little to check this erosion," he added. "We've seen reactions to alcohol, so now we are seeing a reaction to immodest dress."

Jalal Bin Thaneya, an Emirati activist who has embraced the dress code campaign, said it is a way for Emiratis to show they are concerned about the loss of traditions.

"If we were the majority and had the same make up, things would be different," Bin Thaneya said. "You wouldn't need anything. You would see Emiratis everywhere and you would be afraid of offending them ... Now, we're a minority so you feel the need to reach out to an authority."

A drunken couple was caught having sex on the beach and another allegedly having sex in a taxi. A Pakistani was deported for flipping the middle finger at a motorist, and the courts are filled with cases of foreigners having sex out of wedlock.

Most Emiratis rarely come face-to-face with misbehaving foreigners.

The malls, however, are a different story.

They are one of the few places where everyone comes together to escape the brutal summer heat. The cultural clash is hard to ignore, as families of traditionally dressed Emiratis shop and relax in cafes alongside foreign women wearing tank tops, shorts and even transparent gowns over bikinis.

Most malls have policies in place that require "conservative" dress and encourage shoppers to avoid showing shoulders and knees, but few publicize them or enforce them. The police didn't respond to a request for comment but told the Gulf News newspaper there is nothing they can do since there are no specific laws against immodest dress.

"People were seeing it for a long time but they didn't say anything," Bin Thaneya said. "You can't go to the police for such stuff. There is no one to go to. You can't go to the mall management. The mall security guard gets paid less than someone at McDonald's. He isn't going to do anything."

Al-Muhairi's campaign is just one of several over the years led by Emirati women who have tried in vain to enforce the dress code ? handing out brochures, confronting foreigners. But hers has benefited from the growing popularity of social media as well as the Arab Spring popular uprisings, which has given Emiratis a sense they can speak out on some social issues.

The UAEDressCode feed has more than 3,300 followers with a lively discussion that includes plenty of support for a code but also concerns that it would unfairly target foreigners or create divisions between locals and foreigners. Unlike similar campaigns in Kuwait or Saudi Arabia, the impetus for a code has not come from Islamic hard-liners, but from moderate locals like al-Muhairi who love their Starbucks and Western movies but just want foreigners to respect local customs.

"We are not asking others to cover up like us. We are giving them freedom based on their beliefs and religion," al-Muhairi said. "We are not judging and saying this shows she has other interests. We never want to judge. Do whatever you want and wear what you want but with limits. Just respect the public here."

The campaign has caught the attention of the Federal National Council, which pledged last month to push for stronger measures to enforce the dress codes. That came after the country's culture minister, Abdulrahman al-Owais, supported efforts to emphasize the conservative traditions of the UAE.

Members of a half-elected, half-appointed council have suggested a law could include warnings and fines but not jail time for offenders. But the FNC has no law-making powers, so any decision now rests with the UAE government.

"If there is a law, the behavior will be different," said Hamad al-Rahoomi, an FNC member who compared a UAE dress code to laws in France that bans the niqab, in which a veil has only a slit exposing a woman's eyes, or the new dress code at Royal Ascot in Britain that aims to limit provocative outfits.

"We don't want to catch people. We just want people to think of the other parties," al-Rahoomi said. "What I want is to go with my family in my country and not see something that is harming me."

Tourists ? some in skimpy summer dresses, others in shorts and T-shirts ? defended their right to wear what they want, either because it is fashionable or keeps them cool in the summer heat. None of the 10 people interviewed in Dubai and Abu Dhabi knew about a mall dress code, nor were they advised their outfits violated it. Several said a dress code law would go too far.

"I think it's ridiculous because most of the people in Dubai are tourists," said Sarah, a 21-year-old tourist from Kenya wearing a short dress exposing her shoulders and legs. "I want to go somewhere where I would be comfortable in my own skin as a travel destination. I feel comfortable like this and this is how I will dress."

Employees' interests predict how they will perform on the job

ScienceDaily (July 5, 2012) ? When evaluating job applicants, employers want to be sure that they choose the right person for the job. Many employers, from consulting firms to federal agencies, will ask prospective employees to complete extensive tests and questionnaires to get a better sense of what those employees might be like in an office setting. But new research published in the July 2012 issue of Perspectives on Psychological Science, a journal of the Association for Psychological Science, suggests that a different factor -- employee interests -- may be a better way to predict who will perform well on the job.

Although research on vocational interests has been around since the beginning of the 1900s, it usually isn't considered in decision-making related to hiring employees or evaluating applications for college admissions. Why? The existing literature contains mixed findings, making it difficult for researchers and employers to draw conclusions about the true relationship between vocational interests and performance.

"Interests had been ignored in personnel/organizational and educational research until very recently because their validity for predicting performance and tenure at work and in school was misunderstood," says psychological scientist Christopher Nye of Bowling Green University.

To better understand the relationship, Nye and his colleagues from the University of Illinois at Urbana Champaign decided to conduct a comprehensive study to examine whether interested employees and students are more likely to perform well and stay in a job or academic program. To do this, they used a technique called meta-analysis, which allowed them to pool the findings from existing studies on vocational interests and analyze the body of research as a whole.

Nye and his co-authors suspected that one reason that previous studies had produced mixed findings was because they defined interests in different ways. The key, they hypothesized, is not a person's overall interest in a particular kind of work but how their profile of interests across various types of work matches with the profile of skills and tasks involved in a particular job. The researchers surmised that this match -- known as person-environment fit -- would be a much better predictor of performance on the job or in school than the general interest measures used in some previous studies.

A survey of the literature on work, vocational interests, job performance, and academic achievement yielded 60 studies, published from 1942 to 2011, that the researchers were able to include in their meta-analysis. Combined, the 60 studies had a total sample size of 15,301 participants.

The main finding of the meta-analysis confirmed the researchers' hypothesis: while overall interests were moderately correlated with performance and persistence at work and in school, measures that accounted for the person-environment fit were stronger predictors of performance than interest scores alone. Employees' whose interest profiles matched their job profiles were more likely to perform better, help others in the organization, and stay with the company longer. Students whose interest profiles matched the profile of their major were more likely to remain in their program and get good grades.

In a commencement address delivered to Stanford graduates in 2005, then-CEO of Apple Steve Jobs said that "the only way to do great work is to love what you do." According to Nye, these new findings add another dimension: those who love what they do are also more likely to be successful at it.

"These findings are important," says Nye, "because they suggest that organizations may benefit from considering applicants' interests prior to making hiring decisions."

Nye and his colleagues hope to continue their research by examining how best to measure the fit between a persons' interests and a job. "Existing measures of fit between interests and organizations or schools are very broad and crude," Nye says. By exploring what it means to have a 'good' fit and identifying the situations in which fit predicts performance, they hope to help employers and academic institutions apply research on vocational interests to their selection processes.

Mark Mitchell sworn in as new Tempe mayor

Mark Mitchell has been sworn in as the new mayor of Tempe.

He won the mayor's post in May by beating rival Michael Monti and replaces Hugh Hallman, who didn't seek re-election.

Mitchell is the son of former Tempe Mayor Harry Mitchell and served on the city council for 12 years.

He was sworn in on Monday.

In his inaugural remarks, Mitchell said he would focus on regionalism and on forging partnerships with city and state leaders.
